Supreme Court Rules In Favor Of Parental Rights--NEW TEMPLATE FOR PARENTS

Today marks a historic victory for parental rights across America. In a 6-3 per curiam decision issued on March 2, 2026, the U.S. Supreme Court in Mirabelli v. Bonta reinstated a class-wide injunction against California's policies that allowed schools to secretly facilitate children's social gender transitions—using different names and pronouns without parental knowledge or consent, and often actively concealing information from parents.


The Court held that these policies likely violate parents' rights under the Free Exercise Clause of the First Amendment (for religious parents) and the Due Process Clause of the Fourteenth Amendment.

Key excerpt from the opinion:

“California’s policies…cut out the primary protectors of children’s best interests: their parents.”

While the case originated in California, the constitutional principles are nationwide.

The ruling reaffirms that parents—not schools or the state—hold the fundamental right to direct their children's upbringing, education, and mental-health decisions, including matters of gender identity and social transitioning at school.

This precedent directly impacts Illinois families. Some Illinois districts follow guidance or policies (from ISBE or local levels, like Chicago Public Schools) that prioritize student privacy on gender identity, potentially limiting parental notification unless the student consents or parents are already aware.
